AfterHours

Terms of Service

Draft, pending legal review. This document has not yet been reviewed by a lawyer and may change before launch.

Last updated: October 23, 2026

These terms govern the use of AfterHours, the after-hours lead capture service for trades and service businesses in Ontario and across Canada.

1. Agreement

These terms are an agreement between you (the business, and the person who creates the account on its behalf) and Canada Horizon, 2921 Peter Street, Windsor, ON, Canada, which operates AfterHours. By creating an account or using the service you agree to these terms and to our Privacy Policy. You must be at least 18 years old and able to bind the business.

2. The service

AfterHours answers a business's missed calls and public request form after hours, texts the customer back, sorts the request by urgency, and alerts the owner or on-call technician. It also offers lead, job, invoice and payment tools. Urgency sorting is automated and can be wrong. AfterHours is not an emergency service and does not replace 911.

3. Your account

Keep your sign-in details secure and accurate, and tell us at support@getafterhours.ca about any unauthorized use. You are responsible for activity under your account, including your team members.

4. Consent, CASL and CRTC rules

You are responsible for the messages sent on your behalf. You must have consent, as required by Canada's Anti-Spam Legislation (CASL), before sending a commercial electronic message. Every message must identify your business, give a way to contact you, and offer a working unsubscribe. You must honour unsubscribe requests; AfterHours applies STOP replies immediately, and you must not re-add or text an opted-out number outside the service.

You must follow the CRTC Unsolicited Telecommunications Rules, including the National Do Not Call List, for any calls or texts you start, and the PIPEDA obligations that apply to your customers' personal information (including having your own privacy policy and answering customer access and deletion requests). You keep the consent wording shown on your form accurate and do not alter consent records.

5. Acceptable use

You may use AfterHours only to respond to people who contacted your business. You must not: send spam, bulk, cold or marketing messages to people who did not ask to hear from you; import or upload contact lists to message; send messages that are unlawful, misleading, harassing, hateful or sexually explicit; impersonate anyone; send content about prohibited or high-risk categories that carriers filter (for example cannabis, firearms, gambling, high-interest loans or debt relief); try to bypass rate limits, carrier filtering or opt-outs; probe, scrape, overload or break the security of the service; or use it in breach of any law.

We may suspend messaging or the account immediately if we reasonably believe you have breached this section, or if a carrier, Twilio or a regulator requires it.

6. Fees

Paid plans, if any, are billed as shown at sign-up, in Canadian dollars, plus applicable taxes (including HST). Text and call usage may be billed separately. Fees are non-refundable except where the law requires otherwise. We will give at least 30 days' notice of price changes.

7. Your data

You own your business data and your customers' information. You give us permission to process it only to provide, secure and improve the service, as described in the Privacy Policy. You confirm you have the right to give us this information.

8. Third-party services

The service relies on providers such as hosting, Twilio (texts and calls), Resend (email) and a payment processor. Carriers may filter or delay messages, and we do not control their networks. We are not responsible for failures caused by third-party services.

9. Disclaimers

The service is provided "as is" and "as available". To the extent the law allows, we make no guarantee that it will be uninterrupted, error-free, or that every message, call or alert will be delivered, sorted correctly or received in time.

10. Limitation of liability

To the extent the law allows, Canada Horizon is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, jobs, customers or data, arising from the service, including a missed or late lead or alert. Our total liability for all claims is limited to the greater of the fees you paid us in the 12 months before the claim and CAD $100. Nothing in these terms limits liability that cannot be limited by law.

You will indemnify Canada Horizon against claims, fines and costs arising from messages sent on your behalf without the required consent, or from your breach of these terms or of the law.

11. Termination

You may stop using the service and close your account at any time by contacting support@getafterhours.ca. We may suspend or end your account for a breach of these terms, non-payment, or as the law or a carrier requires, and otherwise with 30 days' notice. After closing, you can ask for an export of your data within 30 days; we then delete it as described in the Privacy Policy. Sections that by their nature should survive termination (including consent obligations, limitation of liability and indemnity) do so.

12. Changes to these terms

We may update these terms. We will post the new version here with a new date and email account owners at least 30 days before material changes take effect. If you keep using the service after that, you accept the new terms; if you do not agree, you may close your account.

13. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You and we agree to the exclusive jurisdiction of the courts of Ontario, sitting in Windsor or Toronto, except where the law gives you a right to sue elsewhere.
